Personal data means any information about an identified or identifiable natural person; an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, identification number, location data, an online identifier, or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural, or social identity of that natural person.

II. Sources and Categories of Processed Personal Data

The controller processes personal data that you have provided or personal data that the controller has obtained based on the fulfillment of your order.

The controller processes your identification and contact details and data necessary for fulfilling the contract.
III. Legal Reason and Purpose of Processing Personal Data
- The legal reason for processing personal data is:
- The performance of a contract between you and the controller according to Article 6(1)(b) GDPR,
- The legitimate interest of the controller in providing direct marketing (especially for sending commercial communications and newsletters) according to Article 6(1)(f) GDPR,
- Your consent to processing for the purposes of providing direct marketing (especially for sending commercial communications and newsletters) according to Article 6(1)(a) GDPR in conjunction with Section 7(2) of Act No. 480/2004 Coll., on Certain Information Society Services, in the event that no order for goods or services has been placed.
- The purpose of processing personal data is:
- To process your order and exercise the rights and obligations arising from the contractual relationship between you and the controller; personal data necessary for the successful processing of the order (name and address, contact) are required when placing an order, the provision of personal data is a necessary requirement for concluding and fulfilling the contract, without providing personal data it is not possible to conclude or fulfill the contract by the controller,
- Sending commercial communications and performing other marketing activities.
- The controller does not engage in automatic individual decision-making within the meaning of Article 22 GDPR.
IV. Data Retention Period
- The controller retains personal data:
- For the period necessary to exercise the rights and obligations arising from the contractual relationship between you and the controller and to assert claims from these contractual relationships (for a period of 15 years from the termination of the contractual relationship).
- Until the consent to the processing of personal data for marketing purposes is revoked, but no longer than 5 years if personal data are processed based on consent.
- After the expiration of the retention period, the controller will delete personal data.
V. Recipients of Personal Data (Controller's Subcontractors)
- Recipients of personal data are persons:
- Involved in the delivery of goods/services/payment processing based on the contract,
- Providing services for operating the e-shop (Shoptet.cz) and other services related to the operation of the e-shop,
- Providing marketing services.
- The controller does not intend to transfer personal data to a third country (outside the EU) or an international organization.
VI. Customer Rights
- Under the conditions set out in the GDPR, you have:
- The right to access your personal data according to Article 15 GDPR,
- The right to rectify personal data according to Article 16 GDPR, or restrict processing according to Article 18 GDPR,
- The right to erase personal data according to Article 17 GDPR,
- The right to object to processing according to Article 21 GDPR, and
- The right to data portability according to Article 20 GDPR,
- The right to withdraw consent to processing in writing or electronically to the address or email of the controller specified in Article III of these conditions.
- You also have the right to lodge a complaint with the Office for Personal Data Protection if you believe that your right to personal data protection has been violated.
VII. Conditions for Securing Personal Data

The controller declares that it has taken all appropriate technical and organizational measures to secure personal data.

The controller has taken technical measures to secure data storage and personal data storage in paper form.

The controller declares that access to personal data is granted only to authorized persons.
VIII. Final Provisions

By submitting an order from the online order form, you confirm that you are familiar with the privacy policy and that you accept it in its entirety.
